The Public Gambling Act of 1867, which is the central law on gambling, exempts games of skill from its prohibition. Rummy, as a game of skill, is therefore not prohibited by the central law.

The state-level variations

State laws on gambling vary. Some states have adopted the Public Gambling Act of 1867 directly; some states have their own gambling laws; some states have amendments that affect games of skill.
